Welcome to AgroHub Ghana ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, mobile application, and related services (collectively, the "Service") operated by AgroHub Ghana Limited.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Acceptance of Terms

By creating an account, placing an order, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms constitute a legally binding agreement between you and AgroHub Ghana Limited.

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

We offer different account types including Consumer accounts, Producer accounts, and Admin accounts. Each account type has specific features and responsibilities as outlined in our platform guidelines.

4. Use of Service

4.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable law or regulation
  • To transmit or procure the sending of any advertising or promotional material
  • To impersonate or attempt to impersonate AgroHub Ghana or another user
  • To engage in any other conduct that restricts or inhibits anyone's use of the Service

4.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Attempting to gain unauthorized access to any part of the Service
  • Interfering with or disrupting the Service or servers connected to the Service
  • Using automated systems to access the Service without permission
  • Posting false, misleading, or fraudulent information

5. Orders and Payments

5.1 Order Placement

When you place an order through our Service, you are making an offer to purchase products. We reserve the right to accept or decline your order for any reason.

5.2 Pricing

All prices are displayed in Ghanaian Cedis (GHS) and are subject to change without notice. Prices include applicable taxes unless otherwise stated.

5.3 Payment Methods

We accept various payment methods including mobile money, bank transfers, and cash on delivery. Payment must be received before order fulfillment unless otherwise agreed.

5.4 Order Fulfillment

We will make every effort to fulfill your order as described, but we cannot guarantee availability of all products at all times. We reserve the right to substitute similar products when necessary.

6. Product Information

6.1 Product Descriptions

We strive to provide accurate product descriptions, images, and information. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, or error-free.

6.2 Fresh Produce

Fresh produce is subject to natural variations in size, color, and appearance. We cannot guarantee exact specifications but ensure quality and freshness at the time of harvest and packaging.

6.3 Allergen Information

While we provide allergen information when available, customers with food allergies should contact us directly for detailed information about specific products.

7. Delivery and Shipping

7.1 Delivery Areas

We deliver to specified areas within Ghana. Delivery times and costs vary by location and are displayed at checkout. We reserve the right to modify delivery areas and policies.

7.2 Delivery Times

Estimated delivery times are provided for guidance only. Actual delivery times may vary due to factors beyond our control, including weather conditions and traffic.

7.3 Delivery Acceptance

You are responsible for being available to receive your order at the specified delivery time. If you are not available, we may attempt redelivery or return the items to our facility.

8. Returns and Refunds

8.1 Return Policy

Our return policy is outlined in detail on our Returns page. Generally, fresh produce must be returned within 24 hours of delivery for quality issues, while other items may be returned within 7-14 days.

8.2 Refund Process

Refunds will be processed to the original payment method within 5-7 business days after we receive and inspect the returned items.

8.3 Non-Returnable Items

Certain items may not be eligible for return due to their perishable nature or other factors. This will be clearly indicated on the product page.

9. Intellectual Property

9.1 Our Content

The Service and its original content, features, and functionality are owned by AgroHub Ghana Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 User Content

You retain ownership of any content you submit to the Service, but grant us a license to use, modify, and display such content in connection with the Service.

9.3 Trademarks

The AgroHub Ghana name, logo, and related marks are trademarks of AgroHub Ghana Limited. You may not use these marks without our prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law, AgroHub Ghana Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for any damages arising from or related to these Terms or the Service shall not exceed the amount you paid us for the products or services giving rise to the claim.

You agree to defend, indemnify, and hold harmless AgroHub Ghana Limited and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in your account settings.

13.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

13.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

14. Governing Law

These Terms shall be interpreted and governed by the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
